TERMS AND CONDITIONS OF THE ONLINE STORE artsfromcarparts.com


§ 1. Definitions

The terms used in these Terms and Conditions shall mean:

Store / Online Store – the online store operated by the Seller at: artsfromcarparts.com

Seller – ARTS FROM CAR PARTS Piotr Wierzejski, ul. Złota 75A lok. 7, 00-819 Warsaw, NIP: 5243047116, REGON: 542432205, e-mail: contact@artsfromcarparts.com

Customer – a natural person, legal person, or organizational unit without legal personality who makes purchases in the Store.

Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity.

Entrepreneur with consumer rights – a natural person entering into an agreement directly related to their business activity but not of a professional nature for them.

Entrepreneur – a Customer making purchases in connection with their business or professional activity.

Product – a movable item offered for sale in the Store.

Sales Agreement – a distance sales agreement for a Product concluded between the Customer and the Seller through the Store’s mechanisms.

Order – a declaration of intent made by the Customer using the order form available in the Store, constituting an offer to conclude a Sales Agreement.

Customer Account – an individual panel in the Store assigned to a Customer, containing their data and order history.

Registration – the process of creating a Customer Account in the Store.

Cart – a Store functionality enabling the compilation of selected Products and the determination of Order terms.

Business Day – a day from Monday to Friday, excluding public holidays.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of personal data.

Payment Operator – Shopify International Ltd., headquartered in Ireland (address: 2nd Floor, Victoria Buildings, 1-2 Haddington Road, Dublin 4, D04 XN32, Ireland), as part of the Shopify Payments service, technically supported by Stripe Payments Europe, Ltd. (address: 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland).


§ 2. General Provisions

These Terms and Conditions define the rules for using the Store, including placing Orders, concluding Sales Agreements, delivery, payments, the right of withdrawal, complaint procedures, and personal data protection.

The Terms and Conditions are drawn up in Polish and constitute a contractual template within the meaning of Article 384 of the Polish Civil Code.

To use the Store, the following are required:

  • a device with Internet access,
  • a web browser supporting cookies and JavaScript,
  • an active e-mail account.

Information presented in the Store does not constitute an offer within the meaning of the Civil Code but merely an invitation to submit offers by the Customer.

The Seller reserves the right to temporarily suspend the Store’s operation for technical, maintenance, or reasons beyond its control.

The Customer is obliged to use the Store in compliance with the law, good manners, and these Terms and Conditions.

It is forbidden for the Customer to provide unlawful content, including content that infringes the rights of third parties.

Any disputes arising from these Terms and Conditions may be resolved out of court, in particular before a permanent consumer arbitration court or via the ODR platform: http://ec.europa.eu/consumers/odr


§ 3. Orders

Orders in the Store can be placed 7 days a week, 24 hours a day, through the website artsfromcarparts.com

The Customer may place an Order:

  • as a registered user with a Customer Account,
  • as a guest – without creating a Customer Account.

To place an Order, the Customer selects a Product, then specifies the Order parameters (e.g., quantity, delivery method, payment form), and confirms the selection using the appropriate Store option.

An Order is effectively placed if the Customer correctly fills in the order form and provides data necessary for fulfillment, including the delivery address, e-mail address, and phone number.

The Seller confirms receipt of the Order by sending the Customer an e-mail containing the Order details. Upon receipt of this message, a Sales Agreement is concluded.

If the Seller cannot fulfill the Order (e.g., Product unavailable, price error), they will inform the Customer immediately, no later than 7 days from the conclusion of the Sales Agreement. In such a case, the Customer may:

  • consent to partial fulfillment of the Order,
  • consent to an extended fulfillment period,
  • withdraw from the agreement in full – in which case the Seller will refund the payments made by the Customer.

§ 4. Prices and Payment Methods

All Product prices displayed in the Store are expressed in Polish zlotys (PLN) and include VAT (if applicable).

The price indicated for the Product is binding at the time the Customer places the Order.

The Product price is increased by delivery costs and customs duties, if required by law – indicated each time during Order placement.

The Store provides the following payment methods:

  • electronic payments and card payments handled by the Payment Operator.

The Customer is obliged to make payment within 7 days from the date of the Sales Agreement. In the absence of payment within this period, the Sales Agreement expires.


§ 5. Delivery

Product deliveries are carried out within the territory of the Republic of Poland and, if the Seller provides such an option, to other countries listed in the Store.

The cost of Product delivery is borne by the Customer, unless a promotion or specific offer in the Store states otherwise.

Delivery is carried out via courier companies, postal operators, or parcel lockers – depending on the Customer’s choice.

The delivery time is up to 5 business days, unless otherwise specified in the Product description. In any case, the maximum delivery time shall not exceed 30 days from the date of concluding the Sales Agreement.

For digital Products, delivery consists of providing the Customer with access to a digital file (e.g., a download link or an e-mail delivery) within the timeframe indicated in the Product description.

The Customer is obliged to check the condition of the shipment upon receipt. In case of damage during transport, it is recommended to draw up a damage report in the presence of the courier or to refuse acceptance of the shipment.


§ 6. Right of Withdrawal by the Consumer

A Consumer or an Entrepreneur with consumer rights who has concluded a distance Sales Agreement has the right to withdraw from the agreement without giving any reason within 14 days from the date of:

  • receiving the Product by the Consumer or a person indicated by them other than the carrier,
  • receiving the last item, batch, or part – if the agreement covers multiple items delivered separately, in batches, or in parts,
  • concluding the agreement – in the case of service contracts.

To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by means of an unequivocal statement (e.g., by letter sent by post or by e-mail).

The Consumer may use the model withdrawal form attached to these Terms and Conditions, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient to send the statement before its expiry.


§ 7. Effects of Withdrawal from the Agreement

In the event of withdrawal from the agreement, the Seller shall refund the Consumer all payments received, including delivery costs (except for additional costs resulting from the Consumer’s choice of a delivery method other than the cheapest standard method offered by the Seller), without delay and no later than 14 days from the date of receiving the Consumer’s withdrawal statement.

The refund will be made using the same payment methods as those used by the Consumer in the original transaction unless the Consumer has expressly agreed otherwise – in any case, the Consumer shall not incur any fees in connection with this refund.

The Seller may withhold the refund until the Product is returned or until the Consumer provides proof of return shipment – whichever occurs first.

The Consumer should return the Product to the Seller’s address immediately, and in any case no later than 14 days from the date on which they informed the Seller about the withdrawal. The deadline is met if the Consumer sends the Product back before the expiry of the 14-day period.

The Consumer bears the direct cost of returning the Product.

The Consumer is liable for any decrease in the value of the Product resulting from using it in a way that goes beyond what is necessary to establish its nature, characteristics, and functioning.


§ 8. Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to Consumers with respect to contracts:

  • for the provision of services if the Seller has fully performed the service with the Consumer’s express consent, who was informed before the service began that they would lose the right of withdrawal once the service was fully performed;
  • where the Product supplied is non-prefabricated, made to the Consumer’s specifications, or clearly personalized to meet their individual needs;
  • for the supply of sealed Products which, for health or hygiene reasons, are not suitable for return once unsealed after delivery;
  • for the supply of audio or visual recordings or computer software delivered in a sealed package, if the package was opened after delivery;
  • for the supply of digital content not stored on a tangible medium, if performance has begun with the Consumer’s express consent before the withdrawal period expired and after being informed by the Seller of the loss of the right of withdrawal.

§ 9. Seller's Liability for Product Conformity with the Agreement

The Seller is obliged to deliver a Product that conforms to the agreement.

The Seller is liable to the Consumer and the Entrepreneur with consumer rights for any lack of conformity of the Product with the agreement existing at the time of delivery and revealed within two years thereafter.

It is presumed that any lack of conformity revealed within two years from delivery existed at the time of delivery.

The Consumer cannot rely on non-conformity if they were explicitly informed about it before the conclusion of the agreement and expressly accepted it.


§ 10. Filing Complaints

Complaints should be submitted in writing or electronically to the Seller’s address:

The complaint should include:

  • the Customer’s contact details,
  • a description of the defect or non-conformity,
  • the date the defect was identified,
  • the Customer’s request regarding the method of handling the complaint.

If the data or information provided require supplementation, the Seller will ask the Customer to complete them before processing the complaint.


§ 11. Complaint Procedure

The Seller shall process a complaint without undue delay, no later than within 14 days from the date of its receipt.

Lack of response from the Seller within this period shall mean that the complaint has been accepted.

If the complaint is accepted, the Seller shall:

  • bring the Product into conformity with the contract by repairing or replacing it, or
  • if repair or replacement is impossible or excessively burdensome, reduce the Product’s price or refund the full amount paid by the Customer.

The Customer has the right to request a price reduction or withdraw from the contract if:

  • the Seller has refused to bring the Product into conformity with the contract,
  • the lack of conformity persists despite attempts to remedy it, or
  • the lack of conformity is so significant as to justify withdrawal from the contract.

§ 12. Warranty

If the Product is covered by a manufacturer’s warranty, information regarding its terms and conditions is included in the warranty card supplied with the Product.

The manufacturer’s warranty does not exclude, limit, or suspend the Consumer’s rights arising from statutory warranty (rękojmia) and the Seller’s liability for the Product’s conformity with the contract.


§ 13. Availability and Retention of the Terms and Conditions

Customers may access the Terms and Conditions at any time through the Store’s website:

The Terms and Conditions may be saved, downloaded, and reproduced by printing or storing them on a data carrier.


§ 14. Consumer Protection

The provisions of these Terms and Conditions do not exclude or limit any rights of Consumers granted under applicable law, including the Polish Act of 30 May 2014 on Consumer Rights.

In the event of a conflict between these Terms and Conditions and applicable law, the provisions of law shall prevail.


§ 15. Invalidity of Provisions

If any provision of these Terms and Conditions is found to be invalid, ineffective, or unenforceable, this shall not affect the validity of the remaining provisions.

Any invalid provisions shall be replaced by legal provisions or appropriate substitute terms consistent with the intentions of the parties.


§ 16. Amendments to the Terms and Conditions

The Seller reserves the right to amend these Terms and Conditions.

Amendments shall be published on the Store’s website and shall take effect 14 days after publication.

Orders placed before the amendments take effect shall be fulfilled in accordance with the Terms and Conditions in force on the date of order placement.


§ 17. Copyright and License

All content published in the Online Store, including but not limited to images, graphics, texts, page layouts, trademarks, and other visual elements, are the property of the Seller or entities from which the Seller holds licenses, and are protected by copyright law.

The store’s software and theme operate under a license granted by Shopify Inc. or the theme’s author and remain their property.

Copying, distributing, or using any elements of the Store without the consent of the Seller or the rights holder is strictly prohibited.

The Seller grants Customers a non-exclusive, non-transferable, non-sublicensable license to use the Store solely for the purpose of placing Orders and using the available functionalities.


§ 18. Governing Law and Jurisdiction

These Terms and Conditions are governed by Polish law.

Disputes between the Seller and a Consumer shall be resolved by the common court competent for the Consumer’s place of residence or as specified by applicable law.

Disputes between the Seller and a Customer who is not a Consumer shall be resolved by the common court competent for the Seller’s registered office.


§ 19. Entry into Force

These Terms and Conditions enter into force on the date of their publication on the Store’s website.

They apply to all Customers of the Store, both registered and unregistered, who make purchases.
